Witness Statements: rules and top tips from recent cases

Clare Sibson KC and Joseph Farmer, Fountain Court Chambers

Dealing with witness statements continues to be a core function of the litigation solicitor, and an area which has seen considerable development in recent times in the Business and Property Courts. Our speakers will present an overview of how the courts are dealing with witness evidence and provide practical tips. Drawing on their experience of the very different role of witness statements in criminal trials, our speakers will address the importance of effective "proof taking" and identify the line between legitimate challenging, and illegitimate coaching, of witnesses in advance of trial.
