Early disclosure in the Business and Property Courts: a Practitioner's Guide

Disclosure in the BPC (Commercial Court, Chancery Division, Technology & Construction Court) is now governed by PD57AD. Apart from Initial Disclosure, PD57AD envisages disclosure, in the form of Extended Disclosure (if appropriate) being ordered at the CMC. It makes no express provision for disclosure at an earlier stage of proceedings except by applying CPR 31.16 in respect of pre-action disclosure. This talk will address the circumstances in which the BPC will order disclosure at an early stage (pre-action and pre-CMC), covering the relevant legal principles, practical tips, and strategic pointers from recent cases.
