The Junior LSLA is pleased to announce that we will be holding a live webinar in conjunction with Wilberforce Chambers for junior members of the profession.

Kindly hosted by Penningtons Manches Cooper LLP via Zoom, Jamie Holmes of Wilberforce Chambers will review the case of Carlos Sevilleja Garcia v Marex Financial Ltd [2018] EWCA Civ 1468, which addressed the rule against reflective loss.

In this case, the Supreme Court granted the All-Party Parliamentary Group on Fair Business Banking permission to intervene in the hearing in order to hear public policy arguments in favour of changing the current rule against reflective loss.

While the decision is pending from the appeal that was heard in May 2019, Jamie’s talk will cover the potential outcome of its appeal to the Supreme Court, the circumstances in which fraud and other claims can be brought by creditors, the circumstances in which freezing injunctions will be available to such claimants, and the pros and cons of alternative Insolvency Act interim remedies and claims.
