The nature and basis ofr the award of restitutionary and negotiating damages (also known as Wrotham Park damages) as alternatives to ordinary compensatory damages has been the subject of considerable debate and is of huge importance to practitioners and the outcome of disputes.  In Morris-Garner v One Step, the Supreme Court restated the circumstances in which negotiating damages are recoverable, in a decision which has wide-ranging implications for the recovery also of compensatory and restitutionary damages.  Craig Orr QC's talk examines the likely impact of this decision upon commercial cases.
