Corporate liability under Section 7 of the Bribery Act 2010 and the similarly structured potential offence of failing to prevent economic crimes, the emergence of Deferred Prosecution Agreements and the increasing attacks on corporate claims to privilege all signal a singular direction of travel for the SFO and its affiliates: the company must pay for crimes in its name.
