Sa’ad Hossain QC and David Caplan – One Essex Court Chambers
Sa’ad Hossain QC will discuss overlapping arbitration clauses and the centre of gravity test. Sa’ad will review the “centre of gravity” approach to the allocation of jurisdiction in transactions with multiple arbitration clauses and will also consider potential pitfalls when deciding which clause to invoke. David Caplan will consider a case study on multiple arbitration agreements and address an ongoing long-running saga which illustrates the potential difficulties and pitfalls of the existence of multiple arbitration agreements.
